Promotion of Access to Information Act 2 of 2000 — Section 51 Manual for Smukeliso Sourcing Solutions (Pty) Ltd.

1. Introduction

This manual is compiled in accordance with Section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”). PAIA gives effect to the constitutional right of access to information held by public and private bodies, as provided for in Section 32 of the Constitution of the Republic of South Africa, 1996.

This manual is intended to assist members of the public in exercising their right to request access to records held by Smukeliso Sourcing Solutions (Pty) Ltd.

Certain records are exempt from disclosure in terms of Chapter 4 of PAIA, including:

4. How to Request Records

To request access to records held by Smukeliso, follow these steps:

  1. Submit a written request to: consult@smukeliso.com or by postal mail to 155 West St, Sandown, Sandton, 2031
  2. Include your full name and contact details
  3. Include a clear description of the record you are seeking
  4. State the purpose of your request and the right you seek to exercise or protect
  5. Attach proof of identity (certified copy of ID or passport)
  6. We will acknowledge receipt and respond within 30 days of receiving your request, in accordance with PAIA Section 56

Fees may apply as prescribed under PAIA regulations, including a request fee and reproduction fee depending on the format required.

5. Appeal Process

If your request for access is refused, you may appeal as follows:

  1. Submit a written appeal within 30 days of receiving the refusal notice
  2. Address the appeal to: Zinhle Dube, Information Officer at consult@smukeliso.com
  3. Include your reasons for appeal and any additional supporting information
  4. A decision on the appeal will be issued within 30 days of receipt

If you remain unsatisfied after the internal appeal, you may apply to the Information Regulator of South Africa or seek relief from a court with jurisdiction, in terms of PAIA Section 74.

6. Grounds for Refusal

Access to a record may be refused on grounds set out in Part 3 of Chapter 4 of PAIA, including but not limited to:

  • Protection of personal information of third parties (Section 63)
  • Protection of commercial information of third parties (Section 64)
  • Protection of confidential information (Section 65)
  • Legal privilege (Section 67)
  • Trade secrets and proprietary information (Section 64)

7. Information Regulator of South Africa

The Information Regulator is the supervisory authority responsible for enforcing both PAIA and POPIA in South Africa.
